Breaking News: Form NCUA Board Members file Lawsuit against Administration and Board Chair Hauptman. Yesterday, former NCUA Board Members Todd Harper and Tanya Otsuka filed a lawsuit in the U.S. District Court for the District of Columbia challenging their recent removals and seeking reinstatement to the NCUA Board. Their lawsuit also asks the court to prohibit any final agency action taken by Chairman Kyle Hauptman. In addition to the President, other named defendants include NCUA Board Chairman Kyle Hauptman, Treasury Secretary Scott Bessent, NCUA Executive Director Larry Fazio, and White House Deputy Director Trent Morse. Harper and Otsuka’s action is similar to recent legal challenges brought by other former federal agency officials, including those from the Federal Trade Commission and National Labor Relations Board. While the statutes governing those cases differ somewhat from the Federal Credit Union Act, we understand that these lawsuits may still influence how courts evaluate this latest challenge. At this time, there is no certainty regarding the outcome of the case. However, if the court sides with Harper and Otsuka and grants the relief requested, it could invalidate any final agency actions taken by Chairman Hauptman from this point forward. It’s important for our Dakota Credit Unions to know is that routine NCUA functions, such as supervision, examinations, and the administration of the Share Insurance Fund will not be disrupted. Along with our partners at America’s Credit Unions , we are closely monitoring this situation. We continue to advocate for an independent, bipartisan NCUA Board — a position critical to ensuring balanced oversight for the credit union industry. As the administration has not yet nominated candidates to fill the two vacancies, we will also engage directly with our key congressional contacts in Washington, D.C. as well as the NCUA and America's Credit Unions to understand how Chairman Hauptman plans to proceed as a one-member board.
